Rules of the Virginia credit

The Virginia Earned Income Tax Credit equals 20% of the federal earned income credit, and for tax years 2025 to 2029 that amount is refundable. A family with two children at the 2025 federal maximum of $7,152 receives $1,430; with one child, $866; with three or more, $1,609; a worker without a child, up to $130. It is claimed on Schedule ADJ of Form 760. Virginia keeps a separate nonrefundable credit for low-income individuals, and a household eligible for both takes the one that suits it, since they cannot be combined; the calculator shows the refundable 20%. The Department of Taxation explains both on the same page. The federal eligibility rules apply, including the Social Security number test and the age range for a worker without a child.

Two Virginia credits

The low-income individuals credit is a fixed amount per exemption against tax. The Department of Taxation page sets out how a household chooses between it and the earned income credit.

Questions people ask

What is the largest Virginia earned income credit for 2025?

For tax year 2025, filed in 2026, the calculator finds at most $866 with one qualifying child, $1,430 with two and $1,609 with three or more, and $130 for a worker without a qualifying child. These are the peaks of the curve for a head of household; your amount depends on your earned income and AGI.

Is the Virginia credit refundable?

Yes. Virginia Earned Income Tax Credit is refundable: when it is larger than the Virginia tax you owe, the difference is paid to you, and a household with no Virginia tax at all receives the full amount. That makes it worth the same to a worker with low income as to one who owes tax. You claim it on Form 760, Schedule ADJ.

Who runs the Virginia credit and where is it claimed?

Virginia Department of Taxation administers it, and the claim goes on Form 760, Schedule ADJ, filed with your Virginia income tax return for the same year. It starts from your federal earned income credit, so the federal return comes first and its figures carry over.
