Rules of the Kansas credit

The Kansas Earned Income Tax Credit equals 17% of the federal earned income credit and is refundable, so the part above your Kansas tax is paid to you. It is claimed on line 22 of Form K-40. With three or more children at the 2025 federal maximum of $8,046, it adds $1,368; with two children, $1,216; with one, $736; without a qualifying child, up to $110. The Kansas instructions take the federal amount from your federal return, so the federal eligibility rules apply unchanged. A part-year resident or nonresident multiplies the credit by the share of income from Kansas. For 2026, the rate in the law is still 17%. The Kansas Department of Revenue publishes the income tax booklet each year with the line numbers, which can move from one year to the next.

Questions people ask

What is the largest Kansas earned income credit for 2025?

For tax year 2025, filed in 2026, the calculator finds at most $736 with one qualifying child, $1,216 with two and $1,368 with three or more, and $110 for a worker without a qualifying child. These are the peaks of the curve for a head of household; your amount depends on your earned income and AGI.

Is the Kansas credit refundable?

Yes. Kansas Earned Income Tax Credit is refundable: when it is larger than the Kansas tax you owe, the difference is paid to you, and a household with no Kansas tax at all receives the full amount. That makes it worth the same to a worker with low income as to one who owes tax. You claim it on Form K-40, line 22.

Who runs the Kansas credit and where is it claimed?

Kansas Department of Revenue administers it, and the claim goes on Form K-40, line 22, filed with your Kansas income tax return for the same year. It starts from your federal earned income credit, so the federal return comes first and its figures carry over.
