Rules of the Maryland credit

The Maryland Earned Income Tax Credit works in two layers. The first, nonrefundable, can offset Maryland state tax up to 50% of the federal credit. The second, refundable, equals 45% of the federal credit minus the Maryland tax, and is paid out. A family with two children at the 2025 federal maximum of $7,152 and no Maryland tax receives $3,218. A worker without a qualifying child, single or head of household, receives a refundable credit equal to 100% of the federal credit, and Maryland accepts that worker from age 18. Filers with an ITIN may claim the credit too, with the amount computed as if the federal SSN test were met. The credit is claimed on lines 22 and 42 of Form 502. Maryland counties have their own local earned income credit against the local tax, which this site does not compute.

Reading the two layers

With no Maryland tax, only the refundable 45% counts. With some tax, the first layer wipes out up to 50% of the federal credit in tax, and the refundable layer pays 45% less that tax, so the total is a little higher. Enter your Maryland tax before credits in the calculator to see the split. The Comptroller of Maryland explains the local credit as well.

Questions people ask

What is the largest Maryland earned income credit for 2025?

For tax year 2025, filed in 2026, the calculator finds at most $1,948 with one qualifying child, $3,218 with two and $3,621 with three or more, and $649 for a worker without a qualifying child. These are the peaks of the curve for a head of household; your amount depends on your earned income and AGI.

Is the Maryland credit refundable?

Maryland offers two forms of the credit and the larger one usually depends on your state tax. A nonrefundable part lowers the tax you owe, and a refundable part is paid out even with no tax. The calculator chooses the better option when you enter your Maryland tax before credits. It is claimed on Form 502, lines 22 and 42.

Who runs the Maryland credit and where is it claimed?

Comptroller of Maryland administers it, and the claim goes on Form 502, lines 22 and 42, filed with your Maryland income tax return for the same year. It starts from your federal earned income credit, so the federal return comes first and its figures carry over. Free File, the IRS free filing program, and VITA sites prepare state returns in many states at no charge.
