Rules of the Louisiana credit

The Louisiana Earned Income Credit equals 5% of the federal earned income credit and is refundable. It is set in section 47:297.8 of the Louisiana Revised Statutes and claimed on Form IT-540. With two children at the 2025 federal maximum of $7,152, it adds $358; with one child, $216; with three or more, $402; without a qualifying child, up to $32. It follows the federal eligibility rules, so the calculation starts from the federal amount and nothing else is tested. Louisiana reformed its income tax in 2024, moving to a single rate from 2025, and the statute on the earned income credit kept the 5% rate. Because the credit is refundable, the tax changes do not reduce it. The text of the statute is on the legislature's website.

Small, but worth claiming

At 5%, the Louisiana credit is a few hundred dollars at most. It is still paid only if you file the state return and claim it there, even when you owe no Louisiana tax. The text is at R.S. 47:297.8.

Questions people ask

What is the largest Louisiana earned income credit for 2025?

For tax year 2025, filed in 2026, the calculator finds at most $216 with one qualifying child, $358 with two and $402 with three or more, and $32 for a worker without a qualifying child. These are the peaks of the curve for a head of household; your amount depends on your earned income and AGI.

Is the Louisiana credit refundable?

Yes. Louisiana Earned Income Credit is refundable: when it is larger than the Louisiana tax you owe, the difference is paid to you, and a household with no Louisiana tax at all receives the full amount. That makes it worth the same to a worker with low income as to one who owes tax. You claim it on Form IT-540.

Who runs the Louisiana credit and where is it claimed?

Louisiana Department of Revenue administers it, and the claim goes on Form IT-540, filed with your Louisiana income tax return for the same year. It starts from your federal earned income credit, so the federal return comes first and its figures carry over.
